If you do not agree with these Terms & Conditions, you should not use this website or participate in the online offer process.
1. Purpose of This Website
Transparent Home Offers provides an online platform where approved buyers and their licensed real estate agents may view certain property information and, when authorized, submit online offers during a stated offer window.
This website is intended to support a transparent online offer process. It is not an auction platform, and the highest displayed offer is not automatically accepted by the seller.
Each property may have its own showing schedule, offer deadline, seller concession, technology fee, offer extension rules, approval requirements, and other property-specific terms.
2. Property-Specific Terms
Each property page may contain property-specific offer details, including but not limited to:
Open house or showing times, offer deadline, seller concession, technology fee, offer window extension rules, live offer update settings, buyer approval requirements, and other terms related to that property.
In the event of any conflict between these general Terms & Conditions and the terms shown on an individual property page, the property-specific terms shall control for that property.
3. Eligibility
This website is intended for users who are at least 18 years old and legally able to enter into a binding real estate transaction.
By using this website, creating an account, or submitting an online offer, you represent that you meet these eligibility requirements.
4. Registration Requirement
In order to submit an online offer on a property, buyer must register and create an account on this platform.
Registration alone does not guarantee approval to participate in the online offer process. Buyer or buyer’s agent must provide any required proof of funds, lender approval, or other documentation requested by the listing agent for the specific property.
The listing agent and/or seller will determine whether buyer is approved to participate.
5. Buyer Representation Required
Buyer must be represented by a licensed real estate agent authorized to represent buyer in the state where the property is located.
Buyer’s agent is responsible for advising buyer, reviewing property information, preparing any required purchase documents, and submitting any written purchase agreement if buyer’s online offer is selected by seller.
Use of this website does not create a buyer representation agreement, agency relationship, fiduciary relationship, listing agreement, or buyer-broker relationship between buyer and the website owner, listing agent, brokerage, seller, or platform provider unless separately agreed in writing.
This aligns with the distinction in the reference terms that website use alone does not create an agency relationship or financial obligation.
6. Approval to Submit Online Offers
Before being granted access to submit online offers, buyer or buyer’s agent may be required to provide the listing agent with acceptable proof of funds, lender approval, or other documentation requested for the specific property.
Documents are collected and reviewed by the listing agent outside the website unless otherwise stated for a specific property.
The website does not guarantee that any buyer will be approved to participate. Approval may be granted, denied, delayed, suspended, or revoked at the discretion of the listing agent and/or seller.
7. Online Offer Process
Approved buyers and/or their agents may submit online offers during the offer period shown on the individual property page.
Submitting an online offer does not automatically create a binding purchase contract. A binding real estate purchase contract exists only when a complete written purchase agreement is signed by all required parties and delivered according to applicable law, seller instructions, and the terms of the written agreement.
Once seller selects an online offer for further consideration or acceptance, buyer’s agent may be required to submit a complete written purchase agreement within the time stated on the property page.
8. Highest Displayed Offer Is Not Automatically Accepted
Having the highest offer displayed on the property page does not mean the offer has been accepted.
Seller may consider price, financing type, down payment, earnest money deposit, contingencies, closing date, possession terms, appraisal terms, inspection terms, buyer qualifications, seller needs, and overall strength of terms.
Seller is not obligated to accept the highest displayed offer.
9. Seller Rights
Seller reserves the right to accept, reject, counter, negotiate, or decline any or all offers.
Seller may accept an offer before, during, or after the online offer window unless otherwise stated on the individual property page or prohibited by applicable agreement or law.
Seller may also choose not to sell the property.
10. Seller Concession and Technology Fee
Each property page may disclose a seller concession, technology fee, or other property-specific financial term that may affect the final purchase price, buyer’s total cost, seller’s net proceeds, or closing statement.
The seller concession may be used for buyer closing costs, which may include lender-approved closing costs, compensation to buyer’s agent, and/or a platform technology fee, depending on the specific property terms and the final written agreement.
Unless otherwise stated on the property page:
Selected Offer Amount + Seller Concession = Total Purchase Price
Buyer and buyer’s agent are responsible for reviewing all property-specific financial terms before submitting an online offer.
No term on this website should be interpreted as a “buyer premium.”
11. Offer Window Extension
To help maintain a fair online offer process, the system may automatically extend the offer window when an online offer is submitted near the scheduled deadline.
The extension period and trigger period may vary by property and are controlled by the platform settings in effect for that property.
Unless otherwise stated on the individual property page, the offer window extension rule will be disclosed in the property-specific offer details.
12. Live Offer Updates and Page Refresh
The platform may automatically refresh offer activity at intervals set by the site administrator.
However, buyer and buyer’s agent remain responsible for confirming the current offer status, maintaining internet access, refreshing the page when necessary, and submitting offers before the offer window closes.
Mobile devices, browser settings, cached pages, weak signal, device sleep mode, or other technical issues may affect what a buyer sees.
Buyer and buyer’s agent are responsible for confirming current offer activity before submitting, modifying, or relying on an online offer.
13. Time Zone Responsibility
Each property page will state the applicable offer deadline.
Buyer and buyer’s agent are responsible for confirming the correct deadline and submitting any online offer before the stated deadline.
If buyer or buyer’s agent is submitting from a different time zone, they are responsible for ensuring the offer is submitted before the published deadline based on the time zone shown on the property page.
14. Good-Faith Offers
By submitting an online offer, buyer represents that the offer is made in good faith and that buyer is prepared to submit a written purchase agreement if selected by seller.
Failure to proceed in good faith may result in suspension or removal of buyer’s access to future online offer opportunities.
No withdrawal penalty is imposed by these general Terms & Conditions.
15. Accuracy of Property Information
Property information is believed to be reliable but is not guaranteed.
Buyer and buyer’s agent are responsible for independently verifying all information that may affect buyer’s decision to submit an offer or purchase the property, including but not limited to square footage, lot size, permits, condition, schools, taxes, HOA information, zoning, property boundaries, repairs, disclosures, financing terms, and all other material facts.
16. Property Showings and Access
Property showing times, open house dates, access instructions, and offer deadlines may vary by property.
Buyer and buyer’s agent are responsible for reviewing the individual property page and confirming all showing and access details.
Seller, listing agent, or website owner may change showing times, access procedures, or property availability without advance notice.
17. Offers Submitted Outside the Platform
Seller may request that interested buyers use the online offer process shown on the property page.
Offers submitted outside the platform may be handled according to seller instructions, brokerage policy, and applicable law.
Nothing in these Terms & Conditions is intended to limit any legal duties of a licensed real estate broker or agent.
18. Account Security
Users are responsible for maintaining the confidentiality of their username, password, and account access.
Users are responsible for all activity that occurs under their account.
Users agree not to share account access with unauthorized parties and agree to notify the website owner or listing agent if they believe their account has been accessed without permission.
19. Communications Consent
By registering on this website, buyer consents to receive communications related to account access, property information, approval status, offer activity, document requests, showing information, transaction follow-up, and other matters related to the online offer process.
Communications may be sent by email, phone, text message, or other electronic means.
Buyer may request to stop receiving non-essential marketing communications, but certain transactional or property-related communications may be necessary for participation in the online offer process.
20. Privacy

All website content, design elements, text, graphics, logos, images, software, page layouts, and other materials are owned by or licensed to the website owner or applicable third parties unless otherwise stated.
